These Terms of Service ("Terms") govern your use of physia.shop (the "Site") and your purchase of products from Physia ("we," "us," "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

3. Pricing & Payment

All prices are listed in United States Dollars (USD) and are subject to change without prior notice. We reserve the right to correct any pricing errors.

Payment is processed securely through our third-party payment processor. By providing your payment information, you represent that you are authorized to use the payment method. We are not responsible for any fees your bank or card issuer may charge.

4. Orders & Fulfillment

Placing an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, pricing errors, or suspected fraud. If we cancel your order, we will issue a full refund to your original payment method.

Attempt to gain unauthorized access to any part of the Site

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PHYSIA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

Your use of or inability to use the Site or products
Any conduct or content of any third party on the Site
Unauthorized access, use, or alteration of your data

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

10. Dispute Resolution & Arbitration

Informal Resolution: Before filing any claim, you agree to contact us at support@physia.shop and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If we cannot resolve the dispute informally, you and Physia agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the United States, and the arbitrator's decision shall be final and binding.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

Exceptions: Either party may bring a claim in small claims court if the claim qualifies. Either party may seek injunctive relief in any court of competent jurisdiction to prevent ongoing harm.

11. Indemnification

You agree to indemnify, defend, and hold harmless Physia and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of your use of the Site, violation of these Terms, or infringement of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

13. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Physia regarding your use of the Site and supersede all prior agreements.
